By using our web hosting services, you agree to comply with our policies .

Guidelines, and Disclaimer

Intended for all domains residing on Click ‘N' Host servers.

Age:   The Customer must be 18 years of age to obtain our services. If you are under the age of 18, you must have a parent or legal guardian obtain services for you.

Content and Use of Services:

Free For All (FFA) link sites and using your account for IRC/BBN purposes are not allowed on our servers.

Due to their use of flat files instead of databases, and the massive amount
of server resources they require, Click ‘N' Host does not allow the use of
UBB or YABB bulletin boards. Use of these boards for large or very active forums, results in system performance degradation, and will not be allowed in our shared server environment.

If you are unsure if a software program or script is allowed, please contact us and we will take a look at it.

Click ‘N' Host Acceptable Use Policy (AUP) and Terms of Service (TOS) are provided to give our customers and users a clear understanding of what Click ‘N' Host expects of them while using the service. All users of Click ‘N' Host internet services: those who access some of our Services but do not have accounts, as well as those who pay a service fee to subscribe to the Services, must comply with our Acceptable Use Policy and Terms of Service.

Click ‘N' Host services may be used for lawful purposes only. Examples of illegality, unacceptable content, links and behaviors include but are not limited to:

• Pirated software, pirating (distributing copyrighted material in violation of copyright law, specifically MP3s, MPEG's, ROMs, and ROM emulators)
• Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right.
• Linking to illegal material.
• Collection of personal data:
• Use of Click ‘N' Host' services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.
• Pornography and sex-related merchandising; trafficking in obscene material; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person.
• Stalking.
• Spamming.
• Distribution of mass e-mailing programs.
• Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network.
• Attempt to circumvent any user authentication or Probing the security of any host, network, or account.
• Accessing data not intended for user.
• Distribution of viruses.
• Transmission, distribution or storage of any material in violation of any applicable laws or regulations including the Electronic Communications Privacy Act, the Computer Fraud and Abuse Act, or the Economic Espionage Act...

Disputes:

Click ‘N' Host shall be the sole arbiter of what is and is not a violation of the Acceptable Use Policy or Terms of Service.
Click ‘N' Host reserves the right to:

• terminate an account at any time and for any reason that causes harm to any Click ‘N' Host member's web site.
• delete all content and files upon termination.
• withhold any pre-paid funds for any site removed for violations of these policies.
• refuse or suspend service(s) at our sole discretion.

Disclosure to Law Enforcement

The AUP specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees Click ‘N' Host may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber. In addition Click ‘N' Host shall have the right to terminate all service set forth in this Agreement.

Any violation of these policies may result in immediate account termination or suspension without prior notification and without any refunds. Any Customer who violates our policies will be held responsible for any and all damages to Click ‘N' Host and may be charged a fee for any necessary repairs or clean up.

Customer Responsibility:

The Customer is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery.

The Customer is responsible for securing their username/password.

Contact Information:

You must provide us with, and keep current; good contact information for your account. E-mail, billing address, telephone and fax contacts are used, in that order of preference.

Bandwidth and Disk Usage:

Customer is responsible for monitoring their bandwidth usage.  Customer agrees that bandwidth and disk usage shall not exceed the number of megabytes per month for the Services ordered by the Customer on the Order Form.

Click ‘N' Host shall have the right to take corrective action if Customer's bandwidth or disk usage exceeds the Agreed Usage. Such corrective action may include the assessment of additional charges, disconnection or discontinuance of any and all Services, or termination of this Agreement, which actions may be taken is in our sole and absolute discretion.

It is the Customers' responsibility to maintain local copies of their web site content. Click ‘N' Host will not be responsible for loss of web site files, data, information, etc. *Although Click ‘N' Host backs up the servers on a weekly basis, we strongly recommend that you maintain an up to date backup on your own computer anytime that you update or change your web site. The backups we make are system wide and are geared more toward recovering an entire server rather than a specific domain on that server. Although high quality software is used, nothing is ever guaranteed, therefore we can not guarantee the quality of a recovery, system wide or individual recoveries. So please remember to back up your site frequently.

Limitation of Liability:

Click ‘N' Host shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Click ‘N' Host servers going off-line or being unavailable for any reason whatsoever. Further, Click ‘N' Host shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Click ‘N' Host' servers. All damages shall be limited to the immediate termination of service.

Click ‘N' Host is not responsible for the content of any other web sites linked to the Click ‘N' Host Network; links are provided as internet navigation tools only. Click ‘N' Host disclaims any responsibility for any such inappropriate use and any liability to any person or party for any other person or party's violation of this policy.

Click ‘N' Host is not responsible for any damages your business may suffer. Click ‘N' Host does not make implied or written warranties for any of our services. Click ‘N' Host denies any warranty or merchantability for a specific purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Click ‘N' Host.

Click ‘N' Host reserves the right to change these policies without prior notice or warning. Non-enforcement of any part of these policies does not constitute consent.
